Consignment Terms & Conditions

Terms and Conditions of Service

Overview: Client hereby agrees to retain Experienced Books LLC (EB) as its agent for the purpose of selling Clients books and other media.

Clients Duties: Client is responsible for gathering and packaging and labeling all books and other media that Client wishes EB to sell or dispose of. Client agrees to only provide said books and other media per EBs Acceptance Guidelines. Client agrees to only gather, package and label books in quantities of at least 150 books.

EBs Duties: EB will provide shipping boxes to Client as necessary and will pay for shipping from Clients location to EBs location. EB will receive, inventory, store, sell and ship all books and other media at its cost. EB at its sole discretion will set sales prices for all books and other media. EB will provide accounting of all materials and sales to Client via a website.

Payment: Client agrees that no payment will be made for any books that have been cherry picked or offered for sale or free to employees, the public or any other party. Otherwise proceeds from the sale of Clients books and other materials will be paid as follows:

1. The agreed to percentage of Net Proceeds will be paid to Client on a monthly basis.
2. The remaining Net Rroceeds are earned by EB as its compensation acting as Clients agent to cover its costs of transportation, receiving, inventorying, marketing, software, storing, selling, shipping, customer service, etc Clients books and other materials.
3. Net Proceeds are defined as the amounts received from the sale of the books and other material from the various Internet marketplaces less all commissions paid to said Internet marketplaces, less any credit card or other money transfer fees and less any amounts collected by EB for shipping and handling.
4. EB will pay Client monthly within 30 days of each month end via check or Paypal once the amount owed to Client exceeds $50.

Ownership: Client agrees that ownership of the books and other materials will pass to EB at the moment that the books are picked up from Clients location. Client agrees that EB has the sole and exclusive right to determine at any time if books and other materials are to be removed from sale for any reason. Any such books and other materials may be donated, sold in bulk or recycled at EBs sole discretion.

Termination: Either Client or EB may terminate this relationship at any time. At its sole discretion, EB may refuse to accept any more books and other media from Client, thus terminating this agreement, but EB will still be obligated to make its best efforts to sell any other previously received books and other media from Client.

Changes: EB may unilaterally modify these Terms and Conditions of Service at any time without any notice. A current version of these Terms and Conditions of Service may be found here at all times.
